Terms of Service
1. Acceptance of Terms
By creating an account, tapping "I Agree," or otherwise accessing or using the TMPR Fit mobile application (the "App") or related services (collectively, the "Services"), you agree to be bound by these Terms. You must be at least 18 years old to use the Services — verified via a server-side age gate at registration. These Terms incorporate by reference the TMPR Fit Waiver, Release of Liability, and Assumption of Risk Agreement, which you must separately accept before accessing any workout content. The Waiver governs physical-activity risk and medical disclaimers; these Terms govern your use of the App and Services generally.
2. Description of Service
TMPR Fit provides AI-generated and AI-adjusted training programs, workout session logging, an AI coach chat, progress-photo body-composition analysis, optional Apple HealthKit sync, and push notifications. TMPR Fit is currently in closed alpha testing — features, pricing, and the app itself may change substantially, and we do not guarantee uninterrupted availability.
3. User Accounts and Responsibilities
You must provide accurate information and keep your login secure. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.
4. Payment Terms
TMPR Fit does not currently process payments. Alpha access is granted manually at our discretion, at no charge. Specific billing, auto-renewal, and cancellation terms compliant with California's Automatic Renewal Law will be added before any paid tier launches.
5. Intellectual Property Rights
TMPR Fit, LLC owns the app, its software, design, and branding. You receive a limited, personal, non-transferable license to use the app. You may not copy, reverse-engineer, or create derivative works of the Services, or use our name or branding without written consent.
6. Your Content
You retain ownership of your workout data, progress photos, and chat messages. You grant TMPR Fit a limited license to store and process this content solely to operate the app for you. We do not make your content public or sell it.
7. Prohibited Uses
You may not use the Services illegally, harass others, attempt unauthorized access, scrape the app, introduce malware, impersonate anyone, resell access, or use the Services to build a competing product.
8. Privacy and Data Protection
Our data practices are described in full in our Privacy Policy, incorporated into these Terms by reference. California residents have rights under the CCPA to know, delete, and opt out of sale of personal information — TMPR Fit does not sell personal information.
9. Disclaimers and Limitation of Liability
The Services are provided "as is," without warranties of any kind. TMPR Fit's total liability is capped at the greater of what you paid in the last 12 months or $100, reflecting the app's current free alpha status. This does not limit the separate Waiver governing physical-activity risk, which remains fully in effect.
10. Indemnification
You agree to indemnify TMPR Fit against claims arising from your use of the Services, your content, or your violation of these Terms or third-party rights.
11. Termination
You may delete your account anytime in-app. We may suspend or terminate accounts for violations of these Terms or the Waiver.
12. Dispute Resolution
Governed by California law. We ask for 30 days of informal resolution first. Disputes are then resolved by individual binding arbitration (AAA Consumer Rules) rather than court or class action — you may opt out of arbitration within 30 days of first accepting these Terms by emailing us.
13. Changes to Terms
We may update these Terms as the app evolves. Material changes will be noticed via email or in-app notice at least 30 days before taking effect where practicable.
